Cistrak GPS Ltd Terms & Conditions
The following terms and conditions are a formal agreement between Cistrak GPS Ltd, a UK limited liability company number 6449299 and the purchaser of any of it’s products that are categorised as GPS tracking devices which include a GSM/GPRS service provided by any GSM / GPRS provider. The marks “ Cistrak Pro “ and “ Magpod “ are product names of Cistrak GPS Ltd products and should not be replicated or copied for any other products. The terms and conditions of this agreement will be deemed to have been accepted by the purchaser in the event that Cistrak GPS Ltd has not been notified in the alternative by the purchaser in writing or by email within 7 days of purchase of the tracking device.

Purchase
All goods sold by Cistrak GPS Ltd to resellers or customers shall remain the property of Cistrak GPS Ltd until they have been paid for in full. At the time of purchase goods should have been received in new undamaged condition. In the unlikely event that goods are received in damaged condition the purchaser should immediately report this to Cistrak GPS Ltd or if bought from an authorised reseller, reported to the reseller together with any purchase receipt and return the goods to Cistrak GPS Ltd or the reseller within seven days to receive a replacement product or a refund. Carriage will be paid by the respective sender.

Mapping Software
Every Cistrak GPS tracking device is hosted on a web mapping site by a platform provider. Cistrak GPS Ltd reserves the right to alternate between platform providers at any time without prior notice to customers. Any hosting costs will be charged to the customer by Cistrak GPS Ltd by way of a subscription. The customer agrees to subscribe to Cistrak GPS Ltd for a period of 24 months from date of purchase of products from Cistrak GPS Ltd at the market price fixed by Cistrak GPS Ltd, and Cistrak GPS Ltd reserves the right to change the subscription price at any time giving the customer 28 days notice of such change. The current charge to host a device is £ 70 per annum. Should the customer fail to pay subscription by demand, Cistrak GPS Ltd will forthwith terminate the service to the subscriber and pursue any outstanding subscription amount from the subscriber. From time to time it is necessary to perform maintenance on the web mapping portal and this may result in slight interruptions to the mapping service. The customer understands this event and agrees not to take legal action against Cistrak GPS Ltd or any portal provider for any interruption to the service.

Sim Card Provision
An integral component of Cistrak GPS Ltd tracking devices is the provision of a sim card to provide GPRS reporting to a web based server. The standard sim card provided is a Vodafone Sim card which must be subscribed to for a minimum of 24 months from the date of activation. This buys 15 megabytes of data per calendar month. Thereafter the purchaser deemed to be the subscriber is responsible for each 24 month period billing from Cistrak GPS Ltd payable annually pro rata or by quarterly payments pro rata. The current cost is £ 80 per annum excluding VAT but may vary according to price variations imposed upon Cistrak GPS Ltd by Vodafone or any other GSM network provider. Should the subscriber fail to pay subscription by demand, Cistrak GPS Ltd will forthwith terminate the service to the subscriber and pursue any outstanding subscription amount from the subscriber.
The Purchaser will be allowed unlimited tracking of their device subject to a 15 megabyte per month data allowance. This will allow tracking continually at intervals of 3 minutes within the United Kingdom. Should this allowance be exceeded by the purchaser Cistrak GPS Ltd reserves the right to charge the purchaser for over usage. Failure or refusal by the purchaser to repay the amount claimed by Cistrak GPS Ltd will entitle Cistrak GPS Ltd to suspend the purchaser’s tracking service until the claimed amount is repaid. Cistrak GPS Ltd reserve the right to charge a reasonable amount to the purchaser to reconnect the service following suspension.

SMS Messages
As part of the normal operation of tracking devices SMS messages are sent in order to execute commands to devices to activate their features such as geo fence violations , and speeding alerts. This generates additional cost to the host server ( Cistrak GPS Ltd ) Cistrak GPS Ltd reserves the right to charge the purchaser for the cost of the sms messages at the rate of £ 0.08p per sms message recorded against the purchaser’s account. Cistrak GPS Ltd reserves the right to increase the price in line with that charged to it by it’s suppliers. Should the customer fail to pay SMS costs by demand, Cistrak GPS Ltd will forthwith terminate the service to the customer and pursue any outstanding amount from the customer.

Device Malfunction and Return

In the unlikely event that a customer experiences a malfunction of their tracking equipment the customer should notify Cistrak GPS Ltd as soon as is practicable following the malfunction and in any case within 7 calendar days.  The device should be returned to Cistrak GPS Ltd by recorded delivery postal service.  Cistrak GPS Ltd will upon receipt test the device and whereupon a malfunction is found, will either repair that device or replace it with a similar device within 14 days of receipt of such device. Should the device be deemed to have been tampered with or wilfully damaged then the  damage is the responsibility of the customer. No refunds will be given in any case. Should devices be found to be functioning normally they will be returned to the customer and Cistrak GPS Ltd may at their discretion claim any carriage costs involved.

Covert and unlawful Use Of GPS Tracking Devices
In the event that the customer is using their device in a covert manner and in breach of any laws within any country, Cistrak GPS LTD nor any of it’s agents or resellers will not be held liable for any legal prosecutions whatsoever arising out of misuse by customers. If compelled to do so, Cistrak GPS Ltd will comply with any lawful request to provide any information to the police or other UK Government agency. In the event that a customer sustains personal injury when fitting any covert unit to any vehicle by means of a magnetic attachment supplied by Cistrak GPS Ltd, Cistrak GPS Ltd will not be held liable to any claim whatsoever from the injured party and the injured party will be held wholly liable to themselves for the cause of any injury.
